The Big Bang Casting Contest
Terms and Conditions
Host.
This Contest is promoted, sponsored, and administered by Tribe Gaming Inc. (the “Host”). The Host shall conduct the Contest substantially as described in these Official Rules.
Eligibility.
Participation in this Contest is open to all natural persons who are at least eighteen (18) years old at the time of entry (or the applicable age of majority in their jurisdiction of residence, which is eighteen (18) in most states but is nineteen (19) in Alabama and Nebraska and twenty-one (21) in Mississippi), who are legal residents of the United States and District of Columbia (the “Entrants”). Entrants shall not include persons residing in other territories, such as Puerto Rico, Guam, or the US Virgin Islands, or any other jurisdiction where the Contest is prohibited. Entrants also shall not include employees, or shareholders of the Host and their family members. The Contest is subject to federal, state, and local laws and regulations. Offer is void where prohibited by law. Employees, officers and directors of Host and its subsidiaries, affiliates, sponsors, suppliers, partners, advertising and promotion agencies, and their immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees/officers/directors are not eligible to enter.
Entry Period.
The Contest will begin on May 22nd, 2025 at 11:00 AM CT and shall end on June 9th, 2025 at 7:00 PM CT (the “Entry Period”). Only entries received during the Entry Period shall be considered valid entries into the Contest. The official timekeeping clock shall be the Host’s clock.
Entry.
NO PURCHASE NECESSARY TO ENTER. During the Entry Period, Entrants will be permitted to enter the Contest by:
Scanning a QR code for the Contest, which can be found of physical posters around Austin, Texas;
Completing the submission form (with all required information) the QR Code directs Entrant too; and
Submitting a 1-2 minute video demonstrating Entrant’s personality and creativity in explaining why they should be selected to participate in Event (defined below) (the “Video”). The Video must be submitted through the QR Code, along with the fully completed submission form. (collectively the “Entrance Method”).
Entries made by an Entrant but not complete, received or accepted by the Host are void, and the Host is not responsible for any entries not completed, received or accepted. Any fraudulent interference with the entry process or attempt to breach these Official Rules may result in Entrant’s disqualification from the Contest in the sole discretion of the Host. Only fully completed entries are eligible. Proof of submission of an entry will not be deemed to be proof of receipt by Host.
By submitting an entry, Entrant agrees to be fully unconditionally bound by these Official Rules, and Entrant represents and warrants that Entrant meets the eligibility requirements. Entrants who do not follow all of the instructions or abide by these Official Rules or other instructions of Host may be disqualified. Host may require you to submit certain identification documents to verify your identity and ensure you are eligible to enter the Contest.
By submitting an entry, Entrant acknowledges and agrees that Entrant will clearly and conspicuously disclose that Entrant is participating in a contest in any online social interaction that references the Contest.
No automated entry devices and/or programs are permitted. Receipt of entries will not be acknowledged or returned. Host is not responsible for late, illegible, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human or electronic.
Declaration of Compliance Consent.
By entering this Contest, each Entrant is consenting to and agreeing with the Declaration of Compliance stated below as Exhibit A (the “Declaration of Compliance”).
Limitations on Entries.
An Entrant gets one (1) entry for the Entrance Method described above, for a total of up to one (1) entry per Entrant. For the avoidance of doubt, an Entrant may not enter the Contest more than once. An Entrant may not use multiple accounts to submit an entry. Entries received from any person or account in excess of the stated limitation will be void, and the Host may choose disqualify the Entrant in breach of these Official Rules.
Contest Details.
Entrants will be competing by submitting the most creative, interesting, and exciting Video’s to the Host (the “Competition”), using their skill and ability in the Competition to showcase Entrant’s personality, creativity and to demonstrate that Entrant is the best individual to participate in the Event. The Host shall evaluate each Entrant’s skill in the Competition, to determine the most skilled Entrant. For the avoidance of doubt, throughout the Entry Period, the Entrants shall be ranked in order of skill in Competition, as determined by the Host (the “Ranking”).
The top forty (40) individuals in the Ranking will be considered “Finalists.” All Finalists will then be offered the opportunity to interview with the Host (the “Interview”). During the Interview, the Host will evaluate each Finalists’ poise, excitement, charisma, personality, and creativity. Based on these criteria, the Host shall rank all Finalists in order of skill in the Interviews, as determined by the Host (the “Finalist Ranking”).
Winner Decision.
On June 11th, 2025 at 3:00 PM CT, at the Host’s principal place of business, the Host will attempt to notify the top sixteen (16) Finalists who completed the Interview with the most skill, based on the Finalist Ranking (the “Potential Winners”). The odds of being named a Potential Winner depend on how many Entrants enter the Contest, and each Entrant’s skill in the Competition and Interview. The Host will attempt to notify the Potential Winner(s) via email (to the email address Entrant submits on the submission form as part of the Entrance Method) on or about the date set forth in this section above (the “Notice”). If the Potential Winners cannot be contacted within three (3) days after the date of the Host’s first attempt to contact the Potential Winners, or fail to affirmatively accept the Prize within the same time-frame (the “Response Deadline”), the Host may name the next most skilled Entrant, as determined by the Finalist Ranking of the Entrants in the Contest, a Potential Winner. For the avoidance of doubt, if a Potential Winner does not respond to the Host by the Response Deadline, the Potential Winner will lose any and all right to the Prize (defined below).
Additionally, the next eight (8) Finalists in the Finalist Ranking will be named “Back-Up Potential Winners.” Back-Up Potential Winners may become Potential Winners, in the order they are in the Finalist Ranking, in the event Potential Winners and/or Winners are disqualified for any reason or do not respond by the Response Deadline.
Prize. The “Winner(s)” (defined below) of the Contest will each receive the following prize: an invitation to participate in the Mission Galaxy: The Big Bang (the “Event”), an event and contest hosted by Host on June 20, 2025.
The Host shall provide no further support for a Winner to attend the Event. Winner is fully responsible for travel, food, beverages, lodging, and other incidental costs associated with attending the Event.
No more than sixteen (16) Prizes will be distributed in the Contest. The total retail value of the Prizes detailed in these Official Rules is Zero Dollars USD ($0) for this Contest.The Prize may be delivered to each Winner by manner and means that are in the sole and absolute discretion of the Host. Further, in lieu of the Prize, the Host may in its sole discretion instead deliver the value of the Prize to the Winner. No Prize substitution shall be permitted except at Host’s discretion. The Prizes are nontransferable. Any and all Prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the Winner. The Prize will be fulfilled within approximately one (1) month of the conclusion of the Contest.
Winner Qualification.
Without limiting each Entrant’s consent and agreement with the Declaration of Compliance as stated in Section 5 of these Official Rules, upon request from the Host, each Potential Winner will be required to complete, electronically sign and submit the Declaration of Compliance and all other documentation required by the Host in order for a Potential Winner to participate in the Event (the “Required Documentation”) by the Response Deadline, in order to claim the Prize. If a Potential Winner cannot be contacted, fails to submit the Declaration of Compliance and/or the Required Documentation before the Response Deadline, Potential Winner forfeits any right to the Prize. When a Potential Winner responds to the Host before the Response Deadline, signs and submits the Declaration of Compliance and submits the Required Documentation by the Response Deadline, the Potential Winner becomes a “Winner” of the Contest. All Entrants, Potential Winners, and the Winners (as applicable) must continue to comply with all terms and conditions of these Official Rules and winning the Contest is contingent upon fulfilling all other applicable requirements, as determined by the Company. In the event the Prize is returned as undeliverable, Winner forfeits any right to the Prize. In the event that a Potential Winner or Winner is disqualified for any reason, the Prize will remain un-awarded, to the extent permitted by law.
Publicity Rights.
The Winners (and/or Potential Winners, as applicable) grant to the Host a worldwide, fully paid up, royalty free, sublicensable and transferable license to the Winner’s (and/or Potential Winner’s, as applicable) name, likeness, voice, image, photograph, social media account names, submission information, and any other content produced as a result of entering the Contest, participating in the Contest, and/or winning the Contest (the “Material”) in connection with the promotion, marketing, and making historical reference to this Contest, without notice or additional compensation, except where prohibited by law. Entrants expressly acknowledge that such permission and consent includes the right and ability of Host to use, incorporate, and include the Winner’s Material for advertising, promotional, and any other purposes, in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation and without further compensation, consideration, permission or notification, unless prohibited by law.
Indemnification.
By submitting an entry in the Contest, each Entrant agrees to indemnify, defend, and hold harmless the Host and its affiliates, designees, parents, subsidiaries, employees, directors, officers, representatives and agents from: (a) any and all claims, demands, causes of action and judgments (including attorney’s fees, court costs and expert’s fees) arising out of or relating to any breach by the Entrant of the terms and conditions of these Official Rules and/or the Declaration of Compliance, including any representations and warranties; (b) any other losses, damages, rights, claims and actions of any kind in connection with or resulting from the entrants participation in the Contest or acceptance of any prize, including, without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy; and (c) use by the Host of Entrant’s entry submission or Winner’s (and/or Potential Winner’s, as applicable) Material as set forth in these Official Rules. By agreeing to participate in the Contest, all Contestants further agree to indemnify, defend, and hold harmless the Host and its affiliates, designees, parents, subsidiaries, employees, directors, officers, representatives and agents, and the Judges from: (x) any and all claims, demands, causes of action and judgments (including attorney’s fees, court costs and expert’s fees) arising out of or relating to any breach by the Entrant of the terms and conditions of these Official Rules and/or the Declaration of Compliance, including any representations and warranties; (y) any other losses, damages, rights, claims and actions of any kind in connection with or resulting from Entrants participation in the Contest, including, without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy; and (z) any other losses, damages, rights, claims and actions of any kind in connection with Entrant’s acceptance of, receipt, display, participation in and or/use of the Prize(s) including, without limitation, personal injury, death, and property damage.
Disclaimer, Release and Limit of Liability.
The Host makes no representations or warranties of any kind, express or implied, regarding any Prize or Entrant’s participation in the Contest. By participating in the Contest, Entrants agree to release and hold harmless the Host, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Contest, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in the Contest or receipt or use of the prize (including any travel or activity related thereto), including, without limitation: (a) any technical errors associated with the Contest, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Contest; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) any other errors or problems in connection with the Contest, including, without limitation, errors that may occur in the administration of the Contest, the announcement of the Winner, or the cancellation or postponement of the Contest; or (e) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrants participation in the Contest or acceptance, receipt or misuse of the Prize (including any travel or activity related thereto). Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the greater of (i) the cost of entering and participating in the Contest, if any, or (ii) the sum of Fifty Dollars ($50), and in no event shall the Entrant be entitled to receive attorney's fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. The Contest and all Prizes are provided “as is” and Released Entities make no warranty, guaranty, or representation of any kind concerning any Prize (or any portion thereof) and disclaim any implied warranty.
General Terms.
In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Contest is unable to run as planned for any other reason, including, without limitation, the cancelation or delay of any event that is integral to the Entry Method, as determined by Host in its sole discretion, the Host may, in its sole discretion, either (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Contest and, in the event of termination, award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment. The Host reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the Host or undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Host reserves the right to seek damages (including attorney's fees) and any other remedies from any such person to the fullest extent permitted by law. Host reserves the right, in its sole discretion, to modify, suspend, extend, or cancel the Contest (or any portion thereof) in the event Host is prevented from executing the Contest as contemplated herein by any event beyond Host’s control, including but not limited to: fire, flood, earthquake, explosion, pandemic or other public health crisis, labor dispute or strike, act of God or public enemy, network or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), court order, or federal, state, or local government law, order, or regulation. Failure by the Host to enforce any provision of these Official Rules shall not constitute a waiver of that provision.
Data.
The Host collects person information from each Entrant when the Entrant enters the Contest. The Host will treat all personal information in accordance with any applicable data protection laws and in accordance with the Host’s privacy policy.
Arbitration.
By participating in the Contest, each Entrant agrees that should a dispute arise in any manner concerning or relating to this Agreement between the Entrant and the Host, including the arbitrability of this Agreement, other than injunctive relief and equitable relief, the dispute shall be (i) arbitrated on an individual basis only and shall not be consolidated or joined with or in any arbitration or other proceeding involving a Claim of any other party; and (ii) submitted to and settled by binding and confidential arbitration in accordance with the rules of the American Arbitration Association in Austin, Texas. Parties involved in arbitration shall bear their own legal fees and costs in any arbitration and shall equally split the fees of the arbitration and the arbitrator. Any decision and findings of the arbitrator shall be final and binding on the Parties and held confidential by the Parties, and the Parties agree to execute all documents necessary to maintain such confidentiality. Under no circumstance will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses.
Governing Law and Disputes.
Each Entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Austin, Texas. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Texas, without giving effect to any choice of law or conflict of law rules. COURT PROCEEDINGS HELD UNDER THESE OFFICIAL RULES CANNOT BE BROUGHT, MAINTAINED OR RESOLVED ON BEHALF OF OR BY A CLASS, AS A PRIVATE ATTORNEY-GENERAL, OR IN ANY OTHER REPRESENTATIVE CAPACITY.
Winner List.
To receive a list of the Winner who received the Prize, any individual may request the same for six (6) months after the conclusion of the Entry Period, by mailing a self-addressed, postage-paid envelope to: Tribe Gaming, The Big Bang Casting Contest, 2400 Webberville Rd Austin, Texas 78702.
No Implied Endorsement.
The names of individuals, groups, companies, products and services mentioned herein, associated with Host, or included on any Prize, and any corresponding likenesses, logos and images thereof reproduced herein, have been used for identification purposes only and may be the copyrighted properties and trademarks of their respective owners. The mention of any individual, group or company, or the inclusion of a product or service as a Prize, does not imply any association with or endorsement by such individual, group or company or the manufacturer or distributor of such product or service and, except as otherwise indicated, no association or endorsement is intended or should be inferred. The Contest are in no way sponsored, endorsed, or administered by, or associated with any third-party.
